FOUR S Limited Partnership – General Terms of Service

By accessing, browsing, and using the FOUR S website or Uber Rider apps to use Comfort or Van products, and/or accepting and/or completing a booking using the Uber Rider app to use Comfort or Van products, Customer acknowledges and agrees to have read,  understand and accept the Terms and Conditions set forth below, which constitute an Agreement between FOUR S Limited Partnership (“FOUR S” or “Intermediary”) and the Client.

FOUR S will inform the Customer by email or notification in the Uber app if these terms and conditions change. The Customer will be deemed to have accepted this change as long as he/she continues to use the FOUR S website for travel.

DEFINITIONS

“Agreement” means the agreement concluded between the Mediator and the User in order for the User to access the Mediation Services.

1. Uber Rider App ” means Uber’s mobile application that allows the User to access the Ombudsman’s Services for the purpose of searching for and submitting on-demand requests for Transportation Services.
2. “Territory” means the geographical area of the island of Santorini in which Transportation Companies and their Drivers may offer Transportation Services.
3. “Transportation Company” means a licensed car rental company contracted to FOUR S that executes transportation requests with private passenger vehicles with a driver.
4. “Transportation Services” means the provision of transportation services to the User through the Intermediation Services in the Territory, offered by the Transportation Company and its Drivers using the Vehicles.
5. Intermediary Services” or “FOUR S Services” means electronic services provided by the Intermediary through a digital technology platform sublicensed by Uber B.V., being an on-demand intermediary, and related services that enable Transportation Companies to seek, receive and fulfill on-demand requests for transportation services submitted by Users seeking Transportation Services.
6. “User” or “Customer” means an end user authorized by Uber B.V. to use the Uber Rider app for the purpose of acquiring Mediation and Transportation Services.
7. “User Information” means information about a User made available by the Intermediary to the Transportation Company or the Driver in connection with the User’s request to use the Intermediation and Transportation Services, which information may include the User’s name, pick-up location, contact details, Greek ID number.

9. “Vehicle” means any vehicle of the Transportation Company that meets the applicable legal requirements, as well as the requirements set by the Intermediary for a vehicle.

ABOUT THE FOUR S – OMBUDSMAN

FOUR S Limited Partnership is a limited liability company, registered in Athens, which holds the necessary licenses according to Law 4530/2018 for the provision of Intermediary Services between the Customer, who is a passenger seeking to receive Transportation Services and the Transportation Company, which is a licensed car rental company that executes transportation requests with private passenger vehicles with driver.

ANTIKEIMENO

The FOUR S Services are performed exclusively on the basis of these general terms and conditions.

These terms and conditions apply to all future business relationships with the Customer, even if not expressly re-agreed. Amendments to the conditions, in particular deviation by the Customer of the terms and conditions, are hereby rejected. Silence on the part of FOUR S regarding deviation of terms and conditions shall not be considered as consent, even if FOUR S performs without reservation.

RESERVATION REQUESTS MADE USING FOUR S SERVICES

As an Intermediary, FOUR S mediates between the Customer and the Transport Companies by offering transportation services with private passenger vehicles with driver.

a) Conclusion of the contract for Intermediation and Transportation Services between the Customer and FOUR S after sending a trip request through the Uber Rider application

When the Customer sends a reservation request to FOUR S via the Uber Rider app, the contract for the provision of Mediation and Transportation Services is concluded as long as the respective Driver of the FOUR S contracted Transportation Company accepts the trip request.

Upon conclusion of the contract, (i) a summary thereof containing the main characteristics of the Transportation Service that the Customer will receive using Intermediary Services (including Driver’s name, Customer’s name, Customer’s ID/passport number, Vehicle license plate number, vehicle model, price, starting point of booking, destination;  the start time and end time of the booking) will be generated electronically and shared with the Intermediary and the Driver and (ii) the Customer will receive the driver’s name, license plate number

vehicle, the evaluation of the respective Driver and his location.

b) Cancellations after booking a Transportation Service using FOUR S through the Uber Rider app

If the Customer booked a trip using the FOUR S Services through the Uber Rider app, cancellation up to 2 minutes after the Driver accepted the Customer’s request is free of charge. After 2 minutes, the Driver can cancel the trip. The cancellation fee of 6 euros is charged on each Comfort trip cancellation, 10 euros for Van trips.

If the Customer booked a trip using the FOUR S Services through the Uber Rider app, the Driver will wait for the Customer at the pickup location up to 5 minutes free of charge. After 5 minutes, the Driver can cancel the trip. The cancellation fee of 6 euros is charged on each Comfort trip cancellation, 10 euros for Van trips.

The cancellation fee is paid by the Customer to FOUR S using the payment method indicated by the Customer in the Uber Rider app.

RATES AND PAYMENT TERMS FOR RESERVATIONS FOR TRANSPORTATION SERVICES USING THE FOUR S THROUGH THE UBER RIDER APP.

For bookings requested by the Customer from FOUR S using the Uber Rider App, the price, which consists of the fees for the Transportation Services, will be charged in the name and on behalf of FOUR S using the credit card indicated by the Customer in the Uber Rider App prior to requesting the Intermediation Services (including any taxes and overdue fees that may be incurred).

Alternatively, the Customer may pay the price in cash to the Driver at the end of the trip. Customer agrees that the second payment method specified by Customer in the Uber Rider App may be used as long as the primary payment method listed has expired, is invalid or cannot be charged for other reasons.

After payment the Customer will receive payment confirmation via email.

The following rates are charged for Transportation Services booked through FOUR S using the Uber Rider app.

 

Comfort

Minimum price: 40 euros for a minimum reservation duration of 30 minutes
For reservations over 30 minutes and 40 euros:
o Basic price: 5 euros
Price per kilometer: 1,30 Euro
Price per minute: 0,30 Euro
Paid waiting time per minute: 0,25 Euro, starts 5 minutes after the arrival of the Vehicle at the pick-up point requested by the Customer.

Van

Minimum price: 44 euros for a minimum reservation duration of 30 minutes
For reservations over 30 minutes and 44 euros:
o Basic price: 8,5 euros
Price per kilometer: 2,21 Euro
Price per minute: 0,51 Euro
Paid waiting time per minute: 0,51 Euro, starts 5 minutes after the arrival of the Vehicle at the pick-up point requested by the Customer.

5.2 In case of high demand, prices may increase. The increased price is displayed in the Uber Rider app before ordering the trip. Changing or adding destinations may change the price.

UBER BOAT.

Obligations of the rider.

Captains must check and educate passengers prior to boarding about (i) the rider’s ability to be safe for himself and others during the journey (e.g. drunk passengers should not be allowed on board); (ii) avoid the use of potentially hazardous materials during the voyage (e.g. smoking due to fire), (iii) comply with safety rules and recommendations of masters on board;

Passenger safety:

Life jackets: Ensure easily accessible life jackets are provided for all passengers, including minors, under the seating areas.
Emergency equipment: Confirm that each vessel has readily available fire extinguishers, first aid kits, and emergency signaling devices.
Prohibited activities: For passenger safety, we strictly prohibit drunk passengers, e-cigarettes/smoking and the use of any substances on board.
E-bikes / Scooters: Unfortunately, e-bikes and scooters are not allowed on boats.
Access to the front deck: While the boat is in motion, access to the front deck is strictly prohibited. Please include this information in your communication channels prior to boarding.
Baggage: Due to space constraints, baggage is limited to two pieces of baggage per passenger (this may vary depending on the ship’s capacity).

Security information and procedures:

Safety guides: Provide a safety guide describing emergency procedures in the rear pocket of each seat for easy reference by passengers.
Pre-boarding briefing: Both captains and your communication channels will inform passengers about safety procedures and emergency protocols prior to boarding.

Boat and captain compliance:

Compliance with the High Speed Craft Code (HSC Code): All boats must comply with the High Speed Craft Safety Code (2000) (HSC Code) regulations.
Maintenance and inspections: Regular maintenance and inspections are mandatory to ensure the seaworthiness of vessels.
Maritime regulations: All vessels must operate in accordance with local maritime regulations.
Equipment functionality: Before each trip, make sure that all equipment, including navigation systems and communication devices, is working properly.
Master’s qualifications: All masters must have the appropriate training and certifications for the operation of vessels.
Security Training: Captains will participate in regular refresher courses and security exercises.
Local knowledge: Masters will be aware of local waterways, potential hazards, underwater obstacles, tides and currents.
Weather monitoring: Continuous weather monitoring is crucial.
Route planning: Collaborative routes will be planned in advance to avoid potentially dangerous areas.
Signage: The ship will be clearly signposted, indicating the emergency exits and the locations of safety equipment

USE OF FOUR S SERVICES

The Customer acknowledges and agrees to comply with all applicable laws when accessing or using the FOUR S Services. In order to obtain Transportation Services, a Passenger ID will be generated and the Customer will be asked to provide to FOUR S.

certain personal information, including his/her first and last name, his/her Greek ID or Passport number, as well as his/her pick-up location. Once the Customer submits a request for the provision of Transportation Services, FOUR S will provide him with certain information about the Driver, including the name, photo and location of the Driver, vehicle model and license plate number.

REVIEWS

Customer agrees that after receiving the Transportation Services, they will be asked by the Uber Rider App to provide an evaluation of the Transportation Services and the Driver and, optionally, to provide feedback about these Transportation Services and the Driver.

PERSONAL DATA

The Customer agrees and consents to provide FOUR S with the Data and Information requested, including the User’s name, Greek ID or Passport number and pick-up location, in order to obtain the Intermediation Services and Transportation Services as defined in these terms and conditions, as well as to comply with the obligations arising from the applicable transportation regulations in the Territory. It also authorizes FOUR S, the Transportation Company and its Drivers to use its personal data and other information only for the purposes of providing the Intermediation and Transportation Services as set out in these terms and conditions and to comply with legal obligations.

LIABILITY

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, FOUR S shall be liable for direct damages actually suffered by the Customer due to a breach of FOUR S’s obligations regarding the Intermediation Services.

FORCE MAJEURE

Obstacles to the performance of this Agreement which are not attributable to the risk area of the Party shall release the Contracting Parties from their obligations to fulfil them during the disruption and extent of its effects.  Acts of God, earthquakes, fires, floods, labor disorders, threats to public health, including pandemic events, strikes and blockades, force majeure, riots, acts of war or terrorism, traffic accidents and road blockades, official measures, and other unforeseen and serious events are considered obstacles to the fulfillment of those present.

In such a case, each Contracting Party shall immediately inform the other Party and shall keep the negative effects on the other Party as low as practicable.

 

 

GOVERNING LAW AND JURISDICTION

The construction, validity and fulfillment of these terms and conditions and all obligations arising from or connected with these terms and conditions shall be exclusively governed by and construed in accordance with Greek law. The Courts of Athens shall have exclusive jurisdiction to settle any dispute, action, claim, controversy or cause of action between the parties arising out of or in connection with these terms and conditions.

VARIOUS

Changes and additions to these terms and conditions must be made in writing.

In the event that a term and condition hereof is held to be invalid, the validity of the remaining terms and conditions shall not be affected.
